- Definitions
1.1 For the purposes of these Terms and Conditions:
- “Contract” – the agreement between Earle Ceramics Ltd T/A Penrith Tiles (“Penrith Tiles”) and the Purchaser for the supply of Goods, including these Terms and Conditions.
- “Penrith Tiles” – Earle Ceramics Ltd T/A Penrith Tiles, Scotland Road, Penrith CA11 9JB.
- “Goods” – the items or services supplied by Penrith Tiles.
- “Order” – the Purchaser’s request for Goods.
- “Purchaser” – the consumer buying Goods from Penrith Tiles.
- Application and Precedence
2.1 Nothing in these Terms affects the Purchaser’s statutory rights under the Consumer Rights Act 2015.
2.2 These Conditions apply to all on‑premises showroom sales. Distance and off‑premises sales are governed separately under the Consumer Contracts Regulations 2013.
2.3 No variation is valid unless agreed in writing by an authorised manager.
2.4 The Purchaser acknowledges that no statement outside this Contract has been relied upon.
2.5 Placing an Order or making payment constitutes acceptance of these Terms.
- General Descriptions
3.1 General descriptions are for identification only.
3.2 Product images and samples are illustrative; variations may occur.
- Specification
4.1 Specifications may change without notice.
4.2 Full boxes may be supplied, particularly for special orders.
4.3 Goods are not sold as fit for any particular purpose unless confirmed in writing.
4.4 Slip‑resistance classifications must be checked by the Purchaser.
4.5 Shade and batch variation is inherent in tile manufacture.
4.6 Installation Acceptance
** Once tiles have been fixed, they are deemed to have been accepted by the Purchaser. No claims relating to shade variation, sizing, calibration, surface finish, or any other visible or discoverable characteristic will be considered after installation.
Claims for manufacturing defects will only be considered where the Purchaser can demonstrate that the defect was not reasonably identifiable prior to fixing.**
- Pricing and Payment
5.1 Current price lists supersede previous versions.
5.2 Payment may be made by cash (up to £1,000), credit/debit card, or bank transfer.
5.3 Ownership transfers only once payment is received in full.
5.4 Cancellation of showroom orders is at Penrith Tiles’ discretion and may incur charges.
- Showroom Returns & Cancellation Policy (On‑Premises Sales)
6.1 Change‑of‑Mind Returns
Showroom purchases do not carry a statutory cooling‑off period. Returns for change‑of‑mind are offered only at Penrith Tiles’ discretion.
6.2 Eligibility for Returns
Returns may be accepted only when:
- Goods are stock items
- Goods are in full, unopened boxes
- Goods are in resalable condition
- Goods are returned within 30 days
- Proof of purchase is provided
Non‑stock items, special orders, clearance lines, and discontinued ranges cannot be returned unless faulty.
6.3 Restocking Charge
Approved returns of stock items are subject to a 25% restocking fee. No refund of carriage charges will be given.
6.4 Faulty Goods
Statutory rights under the Consumer Rights Act 2015 apply.
6.5 Shade & Batch Variation
Shade variation is a natural characteristic and not a defect unless significantly outside normal tolerances.
6.6 Special Orders
Special orders are non‑returnable and non‑refundable unless faulty.
- Delivery, Carriage & Risk
7.1 Carriage charges may apply.
7.2 Special deliveries outside our normal area are at the Purchaser’s risk.
7.3 Pallet deliveries will be to the nearest accessible kerbside only. It is the responsibility of the Purchaser to move the product from the road onto their property. Any delivery requests or restrictions must be notified at the time of ordering.
7.4 Risk passes to the Purchaser upon collection or delivery.
7.5 Claims for damages, shortages or incorrect Goods must be made within 48 hours of delivery. This does not affect statutory rights relating to faulty goods.
- Events Outside Our Control
Penrith Tiles is not responsible for delays caused by manufacturer delays, strikes, accidents, or other force majeure events.

- Governing Law
This Contract is governed by English Law and subject to the jurisdiction of the courts of England and Wales.
